Recognition and Enforcement of Judgments under the Brussels I Regulation in the Czech Republic

| Popis | Since becoming one of the Member States of the European Union, the Czech Republic is bound by the Brussels I Regulation (Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters). Brussels I Regulation is an important cornerstone of the European Judicial Area. It sets rules for the free movement of judgments in civil and commercial matters within the Member States of the EU. This free movement of judgments is one of the prerequisites necessary for the development of the internal market. This article deals with the Brussels I Regulation provisions on recognition and enforcement of judgments in civil and commercial matters and analyses, how these rules are applied by the Czech courts. This article by examining the relevant case law of the Czech higher courts answers a question, whether the Czech Republic during its ten years of membership in the EU has endorsed and promoted the free movement of judgments in civil and commercial matters. |
