Popis Issues related to the compulsory vaccination of children and effort of parents to refuse such a legal duty, have recently triggered the discussion on both professional and general level, in Slovakia and also in the Czech Republic. The problem is experiencing a renaissance, when it becomes the topic of a wide-range debates among doctors, parents and lawyers, even though the first decisions of the constitutional courts are dated back to the mid-90s. The important contributions to this debate are also the latest decisions of the constitutional courts in both countries because of the common constitutional tradition. Our article will analyze the latest decisions of the constitutional and other courts in issues related to the compulsory vaccination. We will also take a look at earlier decisions of the courts and focus on the possible evolution in argumentation and interpretation of the courts. We will also use the comparative perspective, taking into account the case law of the European Court of Human Rights.
