| Description | The thesis deals with the legal issue of the enforcement of the measures regulating unfair competition, i.e. self-help, action for a prohibitory order, action to remove the effect of unlawful conduct, action for damages, unjust enrichment, as well as amicable settlement of disputes of unfair competition. I am convinced that the exploration of foreign case law of unfair competition might be very inspiring for the Czech decision-making practice, especially considering the foreign case law of states with very close cultural and legal tradition to the Czech Republic – i.e. Germany and Austria. My thesis is therefore built upon the idea that “acquis communautaire” is not created solely by the directives, regulations and case law of the Court of Justice of the European Union, but by all forms of legal practice and national courts decision-making. The thesis is also based upon the hypothesis that the interest on the compliance with the law of the unfair competition is of both private and public nature. |
