| Description | Competition authorities are limited in their use of electronic evidence by a number of factors and competitors rights. These limitations are to ensure the protection of legal interests of involved competitors. Such limitations include the protection of professional legal privilege and the prohibition of fishing expeditions. Some of these limitations were recently a topic decided on by European courts and therefore require new assessment. |
