Description The paper called “The state as a body responsible for the air pollution – the current developments in case law” deals with analytical analysis of the most recent case law of the Court of Justice of the European Union and the Supreme Administrative Court of the Czech republic on the issue of strict liability of the member state for air pollution within its territory directed towards the question of state liability for failure to comply with the terms of the Directive on ambient air quality and cleaner air for Europe. The main aim of the present paper is to evaluate the conclusions that brings of the current case law in this area and the view de lege ferenda.
