Description The article deals with access to justice of the members of public concerned (both individuals and environmental associations) in environmental matters at the level of the European Union, not only in terms of the Aarhus Convention. First, it is analytically examined the case law of the CJEU and on the basis of which the author wants to answer the question if the current state of European legislation and case law is sustainable (in access to justice in environmental matters). With particular program documents of the European Commission, the EU Council and the European Parliament the author brings possible solutions de lege ferenda that he sees especially in the adoption of secondary EU legislation in the form of a special directive regulated given issue. The aim of this directive should be – as broad as possible, but still reasonable – participation of the public concerned to judicial review of administrative acts in various environmental processes.
