Description The public defendor of rights is considered to be a public body without authoritative power. Nevertheless, it can be assumed that while exercising their powers, a damage can occur. It may happen during the very exercise of their powers in the field of control, publishing of their results or, currently, while exercising the antidiscrimination agenda. The first goal of the paper is to identify the most common cases of a damage caused in such a way and the potentially damaged. The second goal is to consider the possibility of liability of public defendor of rights for the damage in question, including the issue in which cases the application of the Act no. 82/1998 Coll. is possible and in which cases the general regulation of damage liability will be applied.
