Forum shopping in proceedings of international divorce of a marriage

Description The contribution deals with the phenomenon of forum shopping, particularly in relation to international divorces of a marriage. So called forum shopping is the term for the situation in which the person who brings the action before the court (applies for divorce) has a choice of courts in which to file a case. Two or more courts of different countries are competent to decide the dispute (divorce). And the husband or wife who brings an action (submits a proposal to the divorce) as the first one, can choose the court which is the most appropriate for him. He/she selects the court of some country with respect to the distance, or to procedural rules of that state, to the applicable law, to the possibility of recognition and enforcement of the decision in other states and so on. This phenomenon is unwanted because it favours one party. According to European regulation and also to the Czech national law in many cases of international divorces it is possible to establish the jurisdiction of more courts. The aim of this contribution is to analyse the regulation of jurisdiction of international divorce proceedings and evaluate possibilities of using forum shopping and evaluate the attempts to prevent this phenomenon.
