Description | Election Court refused to confirm the mandate of Karel Pergler, a controversial MP, pointing out to the fact that he did not fulfill the condition of Czechoslovak citizenship lasting for the minimum period of three years. Before that, however, Karel Pergler had been holding significant power within the Czechoslovakian state apparatus, meaning he must have been considered Czechoslovakian citizen then. The author briefly presents the merits of the dispute as well as the particular opinions of the key representatives of legal theory. Besides, the specific role of the Election Court is mentioned. The author comes to the conclusion that where the law is - more or less – disregarded, future backfire on those who were involved shall be expected, as soon as the law begins to be applied properly. |
