| Description | The contribution discusses the issue of so-called binding opinions of affected authorities of the state administration, with a particular focus on changes to their procedural regime, which for the area of their most frequent use has brought the amendment to the building act, with effect from 1.1.2018. Changes relate in particular to the mode of their examination in appeal proceedings and in the so-called review procedure. The contribution of these newly introduced differences of the mode of binding of the opinions in construction law from their general adjustment in the administrative order not only points, but at the same time, from the perspective of its authors also expressed as to the suitability of the chosen solution. |
