Description The legal regulation of criminal proceeding against a legal entity is regulated primarily in Act No. 418/2011 Coll., on Criminal Liability of Legal Entities and Proceedings against Legal Entities. The provision of Section 33 of the Act deals with the Issue of Impounding Measures, but not comprehensively. As a consequence, Act No. 141/1961 Coll., Criminal Procedure Code shall be applied in a subsidiary manner. Given the fact that a legal entity is only a fictitious, from a natural person-derived entity that can not act itself legally, it is understandable that some impounding measures as described in the Criminal Procedure Code will not be used in criminal proceeding against a legal entity altogether, others completely and different under certain conditions. The aim of this paper is to engage in discussion and try to find answers to at least some of the many questions that are related to the issue.
