Description The purpose of this article is to analyse the process of reconciliation with the past in the countries of former Czechoslovakia in the sphere of criminal justice. I assume that, when trying to explain the approach of the Czech Republic and Slovakia in this field, it is useful to compare it with the different approach to criminal reconciliation with the communist past taken in the Federal Republic of Germany, where the initial situation and challenges were very similar. The article focuses on criminal sanctioning in what I consider to be the most serious cases, i.e. cases in which the representatives of the former regime violated the most fundamental right– the right to life. In my opinion, these cases provide a clear evidence of such violations, and are generally regarded as the symbols of repressions and inhumanity of the regime.
