| Description | The text deals with a „single-acting concurrence“ of negative facts and legal error on perpetrator, from its excluding, or admission point of view. Specific reason excluding such errors is „the princip priority in bonam partem“. On the contrary, „the princip equity in bonam partem, or in malam partem“ admits such errors. The differentiated assessing of the mentioned errors reflects the differences in the Penal Code (§ 18, § 19), as well as the principles ultima ratio and in dubio mitius. |
