| Description | This article analyses new crime of obstruction of justice according to sec. 347a of Criminal Code. It provides an overlook of this crime, describes reasons for its adoption into the Criminal Code, analyses its systemic relations, points out problems which it might cause in investigation and in the decision making process and presents their possible solution. Those practical problems are especially committing this crime in the course of defense in criminal proceedings, its subjective element and committing this crime by a defense counsel based on an instruction given by a client. |
