Strategy of criminalistics within the criminal proceeding against an accused legal entity

Description Criminal liability of legal entities can still be considered as a relatively new legal issue in most European countries. This issue contains a plenty of different specifics. We can start from the legal action and end up with the question of attribution and the with the question of release. Given that a legal entity is not a natural person of flesh and bone, it is necessary to consider within the criminal proceeding these specificities. Nor is it from a criminalistics point of view, where methods, means, and criminalistics practices leading to the detection, investigation and prevention of criminal activity of a legal entity can not be applied to a legal entity in the same way as to a natural person, but it is necessary to consider in advance which ones may be used, at what time and in what way. Choosing the right criminalistics practice, as well as choosing how to do so, can be key to the success of criminal proceedings against the accused legal entity.
