Description Considering that the human form is being captured during photography, which is related to this protection of personality, this issue is regulated by law, while this regulation is based on from constitutional foundations. The Civil Code sets the conditions under which it is possible to purchase at all a photograph of another person to capture their likeness, as well as the conditions under which such a thing is possible distribute the photo further, or regulates how the image is protected as one of the manifestations of a personal nature falling under personality rights. The present article will therefore focus on under what circumstances can a person's form be captured in the form of a photograph and subsequently this photograph, on which the image of a person is captured, spread.
