| Description | The crime most closely related to the new coronavirus causing COVID-19 is the spreading contagious human disease under Section 152 of the Criminal Code. It affects the forecourt of the real danger of spreading an infectious disease. Causing a consequence in a negligent form covers the neighbouring qualification of the criminal offence of spreading a contagious human disease through negligence pursuant to Section 153 of the Criminal Code. The paper deals with the nature of COVID-19 as a contagious human disease, the construction of the crime of spreading contagious human disease as a threating offence, the crime of spreading contagious human disease in terms of culpability and criminal liability of a legal entity for the spreading of COVID-19. |
