| Description | The monograph focuses on procedural and substantive issues related to administrative expulsion taking into account the specificities of the use of administrative discretion and the proper interpretation of uncertain legal terms. The monograph represents the very first elaboration of this issue in the Czech literature. The authors primarily focused on the issue of limits of administrative discretion and the interpretation of uncertain legal terms. The monograph is based mainly on Analysis of the requirements (limits) that arise (in particular) from the European Convention for the Protection of Human Rights and Freedoms, the Council of Europe soft law, EU law, the Charter of Fundamental Rights and Freedoms and the relevant legal regulations. The authors drew attention to shortcomings in the legislation and practice itself and brought also their critical conclusions with considerations de lege ferenda. |
