| Description | This paper deals with the problematics of hyperlinks placed on websites that enable unauthorized access to copyright and related rights protected subject matters. At the beginning of this paper it is summarised, when and whether it is an infringement of copyright according to decision-making practice of Court of Justice of the European Union, then it deals with The Czech Constitutional Court decision-making practice. The analysed decisions are summed up at the end of paper and there is also clarified its impact on Czech legal framework, especially in the context of criminal law. |
