| Description | The article evaluates a provision of 577 CC as a special expression of the principle in favorem negotii (in favorem contractus). Particular attention is given to the interpretation and the application limits of mentioned provision. On the example of usury is shown that maintaining the validity of the contract is not always desirable - legal acts that are contrary to good morals cannot be protected with reference to the true will of the contracting party, as such a practice would be contrary to the protective and sanction-motivating effect of invalidity. |
