Description This article attempts to answer the question of whether a cyclist is obliged to use a cycle path and is committing an offence by not using it. According to the authors, there is no obligation for a cyclist to use a cycle path. A cyclist can legally use a surface road even if it is close to a footpath or cycle path, as long as it is not marked with a 'No Bicycles' sign. A change in the legislation effective from 1 January 2022 has brought the legal regulation of the different types of "cycle paths" closer together so that a cyclist now de facto does not have to use even a cycle path and other bicycle measures in the law.
