| Description | The article deals with the information obligation on the part of law enforcement authorities towards a user of telecommunications traffic whose subscriber number or device has been subject to an order to intercept and record telecommunications traffic. It outlines the issue in the current de lege lata concept and in the proposed recodification of criminal procedural law. It draws attention to the unenforceability of the sending of so-called information letters and generally discusses classified information concerning interception or surveillance of persons and things. It also presents the relevant case law of the ECtHR on the issues addressed |
