| Description | The article deals with the proposal for partial annulment of the legal regulation on transfer of an employee to alternative work, which was submitted to the Constitutional Court by the Supreme Court. It also discusses the judicial resolution of given case before the submission of the proposal, including reflection of the relevant case law of the Supreme Court. As regards the proposal, authors analyse in particular Supreme Court's main argumentation in favour of annulment of the regulation in question and outline the possible consequences of approval of the proposal by the Constitutional Court. |
