Description The article examines the conceptual and legal foundations that are significant in the European legal environment for discussing the regulation of cohabitation. The aim is to present the main arguments in Europe for and against the adoption of laws regulating cohabitation, with a particular focus on property law aspects. These arguments are connected with the conflict between the principle of protecting the weaker party and the principle of autonomy of will. The goal is also to elucidate the European standards for the legal regulation of cohabitation, primarily derived from European legal systems, the case law of the European Court of Human Rights, academic publications, and international conventions. The analysis demonstrates the existence of a standard for the legal regulation and protection of cohabiting relationships in Europe. The argumentation in favor of adopting legal regulations for cohabitation, at least in the form of basic protective economic rules, is particularly persuasive when there are children involved in the cohabiting relationship.
