Keywords Nature and landscape protection Offenses NGOs Participants in administrative proceedings
Description Public participation in decision-making processes related to the protection of nature and landscape represents a key principle of modern environmental law. For more than three decades, Czech legislation has allowed civic associations (now referred to as associations) to take part in administrative proceedings where interests related to nature and landscape protection may be affected. This possibility, enshrined in Section 70 of Act No. 114/1992 Coll., on Nature and Landscape Protection ("NLP Act"), has undergone significant development over the years—both through legislative amendments and through case law, not only from administrative courts. This paper explores the evolution of this participation, focusing in particular on the question of whether, and under what conditions, environmental associations may act as parties to administrative sanction proceedings under the NLP Act. A significant milestone in this debate was a ruling by the Supreme Administrative Court issued in January of this year, which confirmed the standing of environmental associations in sanction proceedings. The aim of this paper is to familiarize the reader with this recent case law, including the current judicial approach and administrative practice, specifically in relation to the participation of environmental associations in administrative offense proceedings, thereby contributing to a deeper understanding of this critically important issue from the perspective of environmental protection.
