Description | This article analyses the provision of Section 40(4) second sentence of the Czech Copyright Act. It modifies the general regulation of the Czech Civil Code on determination of the scope of compensation for unjust enrichment in cases of disposal with a copyrighted work without the necessary licence and pro¬vides for a lump-sum compensation of double the amount of the usual license fee. According to the opinion prevalent in Czech literature, this special rule performs a punitive function. This function may be inferred by a subjective-historical interpretation of the provision. However, the article attempts to outline a different view of the meaning and purpose of the lump-sum compensation in the context of the relevant EU law and general civil law – even in this case, it should facilitate the proof of the disadvantaged party. Furthermore, the article presents a corresponding alternative view on the application of Section 40(4) second sentence of the Czech Copyright Act. Following the model of the general civil law regulation, it consists of distinguishing the position of the enriched party in bad faith (which should be obliged to pay double the amount of the usual license fee) and in good faith (whose obligation should be limited to the usual license fee only). |
