Description Falcidian portion is a quarter of the decedents' estate that the heir can retain even if he is ordered to give entire estate to the legatees. It is a Roman lawinstitute, which was in the Middle Ages and in the early modern period taken over by legal orders of most European countries, or at least influenced theirlegal development due to the close ties with the institute of forced heirs. Its impact is remarkable in the today's law as well - especially in the Czech Republicas the § 1598 of the Civil Code enacted in 2012 takes it over directly in its Roman law form, which renders the topic to be up-to-date and also useful for legal practice.
