| Description | Although damages is undoubtedly a private law institute, in some cases the Civil Code is not sufficient and the public law regulation must be applied. That kind of situation typically arises when wildlife causes damage. In view of the fact that wolves return to our countryside, this issue is becoming increasingly topical. In order to determine who is responsible for damages, it is necessary to apply Act No 115/2000 Coll. on the provision of compensation for damage caused by selected specially protected animals. It is also necessary to mention the State's liability for damages caused by game according to Act No 449/2001 Coll. The aim of this paper is to discuss in detail the liability for damages caused by animals, in reflection of the current case law of the highest courts. |
