Citation
Description The legal status of captive animals often represents a delicate balance between the exercise of property rights and the protection of animals against cruelty. This paper examines cases in which animal owners become perpetrators of cruelty. It focuses in particular on instances involving puppy mills and other intensive breeding facilities where animals can be kept in inhuman breeding conditions. Based on judicial and administrative decision-making practice, the paper focuses on the criminological profile of the perpetrator of animal cruelty and the associated liability relationships. The article includes a critical analysis of the legislation on (substandard) breeding practices and its possible future development. The paper thus aims to contribute to the debate on the ethics of animal captivity from the perspective of legal practice.
