| Description | The monograph focuses on the issue of acquisition of property rights by increase (accessio) in the draft of the first Austrian codification of civil law, the Codex Theresianus from 1766, and in its revision outlines. In this context, it primarily asks the question of how far the proposed legal regulation adhered to the traditional Roman law concept of accession (accessio), known from the Digest and the Institutions. At the same time, it notes partial modifications and tries to reveal their origin. This concerns not only substantive changes, but also the very categorization of accession, which was gradually formed by the main representatives of medieval and modern legal science. |
