| Description | Optional suspension of proceedings pursuant to Section 109(2)(c) of the Code of Civil Procedure is one of the most frequently applied grounds for suspension of proceedings, but at the same time it is one of the least theoretically developed institutions of civil procedure. In practice, courts repeatedly encounter the question of whether proceedings should be suspended and when, on the contrary, it is more appropriate to bring the matter to a decision or to use other procedural tools, such as joinder of cases or their own assessment of a preliminary question. This article systematically defines the conditions for discontinuance, highlights typical situations addressed by the case law of the Supreme Court, and offers guidelines that may assist courts in considering the appropriateness of discontinuance and the subsequent continuation of proceedings. |
