| Description | The paper deals with the specifics of legal representation of a person with limited legal capacity with special focus on conducting the role of her defence counsel. Firstly, it tackles specifics of the defense of a person with limited legal capacity in general terms, then it specially observes the conflict of will of such a person and his/hers legal representative (defense counsel, legal guardian). In this regard, it analyses basic approaches which appear in the application praxis and which may be conceptually grasped. Consequently it analyses possible approaches to resolving the conflict of wills of the person with limited legal capacity and her representatives. The paper culmitates with a formulation of fundamental theses, which need to be followed when assessing this issue, and a recommendation to a legislative change. |
