Description This article deals with the formal and material aspects of decisions on the reopening of proceedings before the Constitutional Court. The reopening of proceedings is an extraordinary procedural institution allowing for the review of final decisions, particularly in connection with decisions of the European Court of Human Rights finding violations of fundamental rights. The aim of the article is to analyze how the Constitutional Court assesses the fulfillment of formal conditions arising from the Constitutional Court Act when reviewing motions for the renewal of proceedings and how it interprets the substantive criterion of a continuing interference with fundamental rights or freedoms. Based on an analysis of relevant case law, the article shows what requirements are placed on individual criteria and how they are reflected in the decision-making practice of the Constitutional Court.
