| Description | Construction activities are traditionally associated with high demands on natural resources and significant environmental impacts. In a context of increasing demands for resource independence, the requirement for sustainable resource management is becoming increasingly important. This principle is also explicitly enshrined in the new Building Act No 283/2021, through Section 151 of the Act, which lays down the obligation to use natural resources sustainably in construction. The article focuses on the analysis of the legal obligations of the builder when carrying out construction activities in relation to the sustainable management of resources, not only within the framework of national legislation, but also in the context of European and international law, which significantly shape the framework of environmental responsibility in construction activities. At the same time, it focuses on the consequences for the builder of violating obligations related to the sustainable use of natural resources in terms of administrative liability, including sanction mechanisms in the field of waste management, soil, water, forest and landscape protection. The analysis will also include whether the issue of sustainable use of natural resources in construction activities is reflected in the case law of the Supreme Administrative Court, and if so, its relevant conclusions will be discussed. The aim of the article is to assess whether the current legal framework effectively balances the protection of public environmental interests with the requirement for sustainable and efficient use of natural resources in the construction sector and the fulfilment of resource independence. |
