Description Constitution of special protected areas (below only SPA) and the easement (below only ET) generates some restrictions for freeholders. Although the legal act of foundation of special protected areas restricts freeholders in similar way as the easement, it differs from ET. The fundamental differences are following: a) the process of establishing (SPA -- efficiency of legal act of SPA (mostly statutory instrument); ET -- given by law, legal force of decision or on the base of written contract -- in this case the entry in the Land Register is necessary), b) the procedure in the Land Register (SPA -- entry of so-called other fact in the Land Register; ET -- entry of a record in the Land Register), c) the extract from the Land Register (SPA -- information about proclamation of SPA is in section B -- Mode of protection; ET - information about existence some easement is in section C -- Restriction of ownership). Based on the above stated information we can conclude that the constitution of special protected areas and the easement have the same legal substance -- freeholders' restrictions, but different legal forms.
