| Description | The protection of european important areas and the bird areas (Natura 2000) in military territory is on the same level as in the other territory of the Czech Republic. The basic Law for this protection is Law No. 114/1992 Coll., on the protection of nature and the landscape. Important differences are only in competent authorities and in the reservation of protection of european important areas. In the case of european important areas it's in my opinion impossible to use the contractual protection (contract to grant an easement), because both contractual parties are the same (landowner and holder of the easement is one subject - the state). In conclusion the protection of european important areas in military areas is possible only by declaration as the special protected areas (special protected area is the institute of administratory territory protection under the Law No. 114/1992 Coll.). |
