Description Tronc Commun (or common trunk) is a method used in international arbitration to ascertain law applicable to merits of a dispute. Tronc Commun is used by international arbitrators in cases where the contract between parties does not contain a choice-of-law clause and it is also not possible to ascertain which law the parties wanted to apply on their contract. Thus, the question arises - which law should be applied? Mauro Rubino Sammartano, the author of the concept Tronc Commun, has argued that arbitrator ought to apply the common trunk of legal orders of both parties.
