Description This paper deals with the problem of arbitration clauses (not only) in consumer contrasts and possible human rights consideration. Considerations especially from the point of view of the right to a fair trial, fair hearing. The main and in legal literature still unresolved question is if human rights guarantees should be applied to arbitration, voluntary or obligatory arbitration. In my work I will discuss among others the possible application of Article 6 Paragraph 1 of the Convention for the Protection of Human Rights and Fundamental Freedoms, with subsequent additional protocols, to arbitration proceedings.
