Istanbul Convention: Action against Violence against Women and Domestic Violence in Europe

Popis In my short speech, I will first outline the changing view and position of crime victims in criminal proceedings, both within the jurisprudence of the Czech Constitutional Court and the European Court of Human Rights, and within the Czech legislation. I will also point to particular legislative changes adopted in the Czech Republic to protect victims of domestic violence. The main part of my contribution will focus on two important international conventions adopted within the Council of Europe: first, the Convention on Protection of Children against Sexual Exploitation and Sexual Abuse (so called Lanzarote Convention), which entered into force on 1 July 2010 and which deals also with the protection of children against domestic sexual violence. The other convention is the Council of Europe Convention on Preventing and Combating Violence against Women and Domestic Violence (so called Istanbul Convention), which entered into force on 1 August 2014. The Convention lays down a general duty of the state parties to “take the necessary legislative and other measures to promote and protect the right for everyone, particularly women, to live free from violence in both the public and the private sphere”. The convention emphasises the prohibition of discrimination and the principle of equality between women and men. Both conventions oblige the state parties to punish the perpetrators of violence, to prevent such acts, to support the work (relevant projects and programmes) of NGOs and civil society, and to ensure co-ordination on a national level between the relevant agencies and organisations, policies and measures. The Czech Republic as well as other Central and Eastern European states have not ratified the Istanbul Convention so far and there has been substantial political debate going on, contesting some of the Istanbul Convention grounds, in particular the issue of education against gender stereotypes.
