Description Although the leniency has been applied as a soft law in the Czech Republic since 2001, it was codified ten years later. A part of the codification are the rules setting down the conditions of the office for protection of competition files inspection while applying the leniency (declared is a necessity of national legislation reflecting the ruling of Court of Justice of the European Union in the Pfleiderer case). The national solution of the troubles arising between public and private enforcement of the competition law is, however, only halfway. The aim of the paper is to scan the legislation of competition office files inspection when the leniency is being applied, and to mark up the potential problematic issues.
