| Description | The article deals with the issue of compensation for the non-pecuniary damage of persons imprisoned during communism. The question, if the persons are entitled to claim the compensation, was decided differently by general courts and the Constitutional Court of the Czech Republic. The Plenum of the Constitutional Court adopted a unifying opinion Pl. ÚS-st. 39/14. However, this opinion didn´t solve the problem completely. The author points out the controversial points of the opinion and also suggests possible solutions. |
