Description Present paper deals with possible Roman-law-based inspiration of § 133b of Czech Civil Procedure Code. The § 133b stipulates a presumption of intellectual property to whole collection of things when an appropriate sample is examined. This in principle corresponds to vindication of flock in D 6, 1, 1, 3 Ulpianus 16 ad ed. in connection with D 6, 1, 2 Paulus 21 ad ed. Both in Roman and Czech law, the presumption is construed as rebuttable, therefore owners of individual things can claim their property independently from the vindication of flock (D 6, 1, 23, 5 Paulus 21 ad ed) which has only a procedural impact.
