| Description | The article deals with the question of subject-matter competence of courts the judicial protection against inaction of an administrative authority in response to obiter dictum contained in the decision of the Constitutional court dated 2. 12. 2015, filing reference I. ÚS 2355/15. The author firstly deals with question from the viewpoint of the existing case law of the Supreme Administrative Court and the Constitutional Court. Further author made a critical analysis of the opinion mentioned in the decision of the Constitutional court dated 2. 12. 2015, filing reference I. ÚS 2355/15, both in terms of its content and of the form its presentation. In the end the author deals with the practical effects of the possible change of the existing case law in the meaning the presented criticized opinion of the Constitutional Court. |
