Citation
Description This text follows an article from 2010. It comments on the current situation and mainly the potentional shifts in the matter of conception of basic principles of criminal procedure / criminal process law legis ferendae, on the backround of Draft Law of the New Criminal Procedure Code of the Czech Republic of 2007/2008, 2009/2010 and 2014 (2016). It points out, just as the original text, the importance of basic principles from the perspective of their formulation in the new Criminal Procedure Code, particularly from the work of police, judiciary and prosecuting authorities´ point of view, during the interpretation and application of the new criminal process legislation. This text topically suggests problems of the admissible and non admissible exceptions from the principles too, in the context of Europeanisation of the Czech criminal process law. Conclusion: Basic principles are necessary to be formulated in the Criminal Procedure Code explicitly, as one of the prerequisites of the right interpretation and application of the Criminal Process Code. The same is valid for the admissibility and non admissibility of related exceptions.
