| Description | According to § 1630 sec. 2 of Cyech Civil Code (corresponding to § 6936 of Austrian Civil Code), the legatee can refrain from his duty of contribution into the estate by by giving the legacy with its revenues (if we read the text word by word, the fruits are excluded). However, having considered both the take over of the text of § 1630 from the Austrian Civil Code and the purpose of legal regulation, we find out, that the fruits are included as well. |
