| Description | The paper focuses on the interconnection of the institute of detention of migrants with the means of protection against inactivity of administrative bodies involved in the proceedings on detention. The first part of the paper will focus on the definition of the institute of detention of third-country nationals both from the perspective of European Union law and from the perspective of domestic legislation. The next part of the paper will be devoted to legal means of protection against inactivity of administrative bodies involved in detention proceedings within asylum and migration procedures. The article will also outline the decision-making practice of the Court of Justice of the European Union and the Supreme Administrative Court in the field of detention of third-country nationals. |
