| Description | This paper deals with the concept of active repentance, which represents one of the ways of extinction of criminal liability of the offender. At first it deals with the different kinds of active repentance. There are presented the conditions for the application of the concept in case of criminal activity of adult offenders. It focuses on the general active repentance stated in section 33 of the Criminal Code and the special cases of active repentance stated in the special part of the Criminal Code. Furthermore, the paper deals with the special case of active repentance, which is applicable in the case of criminal activity of the juveniles. Consequently, it provides the comparation of the conditions for applicability of those concepts. In the next part of this paper there are presented the reasons for such a legislation stated in section 7 of the Juvenile Justice Act. This article tries to clarify the way in which is the principle of restorative justice manifested in the legislation. |
