| Description | The essay recaps actual fundamental theoretic views, legal regulations and also the practice of the courts of the Institutional court of the Czech Republic and the European court of Justice towards the problems of retroactivity. Subsequently, the essay deals with the problems of retroactivity from the point of view of non-retroactive legal regulations and inter-temporal provisions of the law, and the interpratation of the valid law. Finally, some parts of the essay mention the problems of retroactivity in connection with the period of transit from communistic to democratic regimes. |
