| Description | Chapter is endowed to problems of legal interpretation and its various types in different legal contexts. The essential distinction between binding and non-binding is made first and in the following text the main attention is paid to traditional interpretive approaches (elements, methods) of legal interpretation. The text comprises not only theoretical explanation, but also numerous examples from legal practice, particularly legal provisions and case law. Specific interpretive approaches connected with individual legal branches and sub-systems are shortly analyses, too (e. g. private law, public law, EU law etc.). Last but not least, the problem of legal gaps and their solution is characterized. |
