Description The monograph aims to analyze the regulation of free legal aid in the Czech Republic. Although there are many works that deal with particular problems ( e. g. representation in civil proceedings or cases of ex offo defense in criminal matters) there is still lack of a comprehensive assessment of the issue, what is the mission of presented work. Introductory chapters focus on the limits of legislator’s discretion in the branch of free legal aid, I. e. the responsibilities that arise from the Czech constitutional order, international treaties and EU law. Other chapters deal with in-depth analysis of the various institutes of free legal aid in the Czech Republic. Work does not only describe valid and effective legislation, but also follows the interpretation carried out in the case law of the ordinary courts and the Constitutional Court. The third part is devoted to a comparison. The situation in the Czech Republic compared with those in several other European countries. In conclusion, authors identify the main problems of the current system of free legal aid and the biggest challenges that await the legislature.
